Three lawyers discuss how electronic health records will impact malpractice claims and change discovery during lawsuits.

Michael Kelton, Esq., a partner with Abrams Fensterman and director of the firm’s Medical Malpractice Defense Practice, explained that he believed EHRs affect the litigation of malpractice cases mostly through the discovery of metadata.

“One of the first things that I request now is to have an audit trail,” Lori Abel Meyerhoffer, MD, JD, echoed. “I want to know everyone single person who hit that chart, what they did in it, how long they were there, what they modified.”

Plus, Todd Bartos, Esq., defense trial lawyer with Stevens & Lee, goes into detail how the metadata works and the pros and cons of being able to so closely track all of the interactions.
