Physician's Money Digest, November15 2004, Volume 11, Issue 21

If either of your parents'wills wasdrawn up several years ago, there's achance that the witnesses may have diedor moved away. That's not a problem, legal experts say, if the will has what isknown as a self-proving affidavit. This isa statement from the witnesses that basicallysays that when the will was written, your parent was over age 18, of soundmind, and not under any undue influence. If there's no such statement in thewill, the courts will most likely accept it,but to be safe, it's a good idea to draw upa new will with new witnesses. To besure about state laws governing witnesses, check with an attorney in the statewhere your parents live.
